1.1 Definitions:

Headings and subheadings are provided for convenience only and shall not affect the interpretation of these Terms.

2.1 License Grant:

Upon acceptance of these Terms, Safiri by Citrus grants the User a non-exclusive, non-transferable, revocable license to access and use the Service solely for personal and educational purposes related to school transport management.

2.2 Scope of Use:

Users shall use the Service strictly in accordance with these Terms and for its intended purpose only. Unauthorized use, reproduction, or distribution of the Service is prohibited.

3.1 Eligibility:

Users must be legally eligible and have the requisite authority (or consent from a parent/guardian, where applicable) to enter into a binding contract under Kenyan law.

3.2 Account Registration:

Users must provide accurate and complete information during registration. Users are responsible for maintaining the confidentiality of their login credentials and must notify Safiri by Citrus immediately if they suspect unauthorized use of their account.

4.1 Subscription Plans:

Any subscription plans offered under the Service (if applicable) shall be detailed separately. Users will be informed of the pricing, billing cycles, and renewal policies at the time of subscription.

4.2 Payment Terms:

Payment for any subscription services will be billed on a recurring basis as specified. Failure to pay may result in suspension or termination of the User's account.

4.3 Refund Policy:

Refunds, if any, will be provided in accordance with the terms set forth at the time of purchase and in compliance with applicable laws.

5.1 Prohibited Activities:

Users shall not engage in any activities that:

• Misuse or interfere with the Service;
• Attempt to gain unauthorized access to the Service;
• Scrape, copy, or distribute any part of the Service;
• Violate any applicable laws or regulations.

5.2 User Responsibilities:

Users are responsible for maintaining the security of their accounts and for all activities conducted under their account. Users must promptly report any suspicious activities or security breaches to Safiri by Citrus.

6.1 Ownership:

All intellectual property rights in the Service, including but not limited to the software, design, logos, text, and proprietary content, are owned by Citrus Labs Limited or its licensors.

6.2 User-Generated Content:

Users retain ownership of any content they provide; however, by submitting content, users grant Safiri by Citrus a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for the purpose of operating the Service.

7.1 Data Collection and Use:

User data is collected, used, stored, and shared in accordance with our Privacy Policy, which is incorporated by reference. Safiri by Citrus commits to compliance with Kenyan data protection regulations.

7.2 User Consent:

By using the Service, users consent to the collection and use of their personal data as described in the Privacy Policy.

8.1 Disclaimer:

The Service is provided on an "as is" and "as available" basis without any warranties, express or implied, including without limitation any warranties of merchantability or fitness for a particular purpose.

8.2 Limitation of Liability:

To the fullest extent permitted by law, Citrus Labs Limited shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Service. The total liability of Citrus Labs Limited shall not exceed the amount paid by the User (if any) in the 12 months preceding the claim.

10.1 Term:

These Terms shall commence on the Effective Date and continue until terminated by either party.

10.2 Termination:

Either party may terminate this Agreement by providing 30 days' written notice. Upon termination, the User's access to the Service will be revoked, and any outstanding obligations will become immediately due. Data may be deleted or archived in accordance with the platform's data retention policy.

11.1 Governing Law:

These Terms shall be governed by and construed in accordance with the laws of Kenya.

11.2 Dispute Resolution:

Any disputes arising out of or related to these Terms shall be resolved through negotiation, and if necessary, mediation or arbitration, before resorting to litigation. The parties agree that the courts of Nairobi, Kenya, shall have exclusive jurisdiction over any disputes.

14.1 Force Majeure:

Citrus Labs Limited shall not be liable for any failure to perform its obligations under these Terms due to causes beyond its reasonable control, including natural disasters, acts of government, or other unforeseen events.

14.2 Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
